BrainScraper Privacy Policy

This Privacy Policy describes how Brainscraper LLC, operator of brainscraper.io (“BrainScraper,” “we,” “us,” or “our”), collects, receives, uses, processes, stores, discloses, and otherwise handles personal information in connection with BrainScraper’s website, data-enrichment platform, software, and related services.

1. Our Role

BrainScraper provides data discovery, aggregation, matching, and enrichment technology.

BrainScraper may identify, aggregate, match, organize, or return information obtained from a broad network of publicly available directories, records, websites, databases, third-party sources, data providers, and other publicly or commercially available sources.

BrainScraper provides technology that streamlines the process of locating and enriching information. The appearance of information through BrainScraper does not mean the individual concerned has consented to being contacted by a BrainScraper User.

A mobile telephone number, email address, or other contact detail appearing in BrainScraper is not evidence of consent or opt-in authorization.

2. Information We May Process

Depending upon how BrainScraper is used, we may process categories of information including:

Account Information

This may include names, usernames, email addresses, account credentials, company information, billing information, subscription information, and account preferences.

Imported Data

Users may upload, submit, or import information to BrainScraper for matching, enrichment, aggregation, or processing.

Imported Data may include information relating to individuals or businesses.

Enriched Information

BrainScraper may locate, match, aggregate, append, or return information including:

  • mailing or physical addresses;
  • telephone numbers;
  • mobile telephone numbers;

  • other information available through public or third-party sources.

Usage and Device Information

We may collect information concerning how BrainScraper is accessed or used, including IP address, browser type, device information, operating system, access dates and times, pages or features used, error logs, and similar technical information.

Communications

If you communicate with us, we may retain information contained in your request and our response.

3. Sources of Information

  • directly from Users;
  • when Users import or submit data;
  • automatically when Users interact with BrainScraper;
  • from publicly available directories;
  • from public records;
  • from publicly accessible websites;
  • from business and professional directories;
  • from third-party data providers;

  • from other lawful sources.

Information obtained from public or third-party sources may be inaccurate, outdated, incomplete, or incorrectly associated.

  • matching and enriching records;
  • identifying potentially corresponding records across sources;
  • aggregating information;
  • returning enrichment results to Users;
  • processing User requests;
  • maintaining accounts;
  • authenticating Users;

  • improving the platform;
  • measuring performance;
  • preventing fraud, abuse, or security incidents;
  • enforcing our Terms;
  • maintaining platform security;
  • responding to lawful requests;
  • complying with legal obligations; and
  • protecting BrainScraper, its Users, and others.

5. Contact Information Is Not Consent

BrainScraper’s discovery or provision of a telephone number, mobile telephone number, email address, or other contact information does not mean that BrainScraper or the contact has authorized a User to initiate communications.

BrainScraper Users are contractually required to independently obtain all legally required consent or opt-in authorization before using information obtained through BrainScraper for calls, text messages, marketing, solicitation, or other outreach.

Users may not treat data returned through BrainScraper as evidence of consent.

6. Responsibility of BrainScraper Users

Users control their own downstream use of information they import, access, export, download, store, transfer, process, or otherwise use outside BrainScraper.

Each User is solely responsible for determining whether that activity is permitted by applicable law.

In particular, Users are solely responsible for:

  • obtaining any consent required before contacting an individual;
  • maintaining proof of consent where required;
  • processing opt-out and do-not-contact requests;
  • complying with applicable privacy and consumer-protection requirements;
  • securing information after exporting or downloading it;
  • establishing an appropriate lawful basis for processing; and
  • responding to applicable privacy-rights requests concerning data within the User’s own systems.

BrainScraper does not authorize a User to contact an individual merely because BrainScraper located or returned that individual’s contact information.

7. How Information May Be Disclosed

We may disclose information as reasonably necessary to operate BrainScraper, including to:

Service Providers

We may use hosting providers, cloud infrastructure companies, security providers, payment processors, analytics providers, customer-support providers, and other vendors assisting our operations.

BrainScraper Users

Where the purpose of the Service is to match, enrich, aggregate, or return information, information may be provided to the User requesting the applicable enrichment or processing operation.

Legal and Safety Purposes

We may disclose information where reasonably necessary to comply with law, legal process, court orders, regulatory requirements, or valid governmental requests, or to protect rights, safety, security, and property.

Corporate Transactions

Information may be disclosed or transferred as part of a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar transaction.

8. Data Enrichment and Publicly Available Information

Some privacy laws distinguish between information collected directly from an individual and information available through public records or other publicly available sources.

13. Public-Source and Enriched-Data Requests

Because BrainScraper may compile information from public and third-party sources, removing information from BrainScraper does not necessarily remove that information from the original source.

Where legally required, BrainScraper will process applicable privacy requests concerning information within its control.

BrainScraper may need sufficient information to identify the applicable record and verify the requester.

BrainScraper is not intended for children under 18.

Users may not knowingly use BrainScraper to obtain or process information concerning children for unlawful or inappropriate purposes.

BrainScraper is not responsible for communications, marketing campaigns, solicitations, exports, databases, or other downstream activities independently undertaken by Users after information is provided through BrainScraper.

To the maximum extent permitted by law, BrainScraper disclaims responsibility for losses, claims, investigations, penalties, or damages resulting from a User’s unauthorized, illegal, non-compliant, or otherwise improper use of Imported Data or Enriched Data.

This includes, without limitation, use of mobile numbers without legally required consent or opt-in authorization.

18. Changes to This Privacy Policy

We may update this Privacy Policy periodically.

We will update the Effective Date when changes are made and will provide additional notice when required by law.
